Scooters
50 cc or
less:
A Class E License or higher is required to ride
a motor scooter on public roads and quasi public
roads (parting lots and gated communities) in
Florida - If 50 cc or less, these vehicles are not motorcycles by driver license law definition, F.S.,S. 322.01(25),
therefore a motorcycle endorsement is not
required per FSS. 322.03(4); however, to operate them on streets and roadways, you must be at least 16 years old and hold at least a regular operator (Class E) or “Motorcycle Only” driver license.
Even though these vehicles are 50 cc or less, they still fall under the driver license law definition of Motor Vehicle
and a driver license is required to operate a
motor vehicle. FSS 322.03(1), FSS 322.01(26) and
FSS 322.05(1), The scooter must be street legal, (proper operating equipment- brake lights, headlight, mirror, etc.)

Definition of motorcycle - FSS 322.(26)
"Motorcycle" means a motor vehicle powered by a motor with a displacement of more than 50 cubic centimeters, having a seat or saddle for the use of the rider, and designed to travel on not more than three wheels in contact with the ground, but excluding a tractor or moped.

To ride a scooter of 50cc or less the rider
must be at least 16 years old a driver's license to
operate a motor vehicle. Vehicles that are over 50 cc's,
fall under Florida State Statue 322.03 (4), F.S., “A
person may not operate a motorcycle unless he or she
holds a driver’s license that authorizes such operation,
subject to the appropriate restrictions and
endorsements.” and a motorcycle license is required.
50cc's or less - A motorcycle endorsement
is not necessary. You still need to register your moped
or scooter with the Division of Motor Vehicles, |

Scooters more than 50cc's - For the purpose of Florida law a scooter more
than 50cc is a motorcycle and you must have a Florida Motorcycle license to
legally ride a the scooter. You are required to take the Basic Rider Course to
obtain you motorcycle license. MSF approved motorcycle safety course
(BRC) for scooters - Most motorcycle safety courses in Florida
do not make the distinction between a motorcycle and a motor scooter over 50cc.
The course to obtain a Florida license is run with manual transmission
motorcycles. This can be frustrating and irritating for those that have no
intention of riding a motorcycle, but do want a scooter powerful enough to ride
on public streets and in some cases highways.
